His car failed the post-race inspection, and NASCAR officials disqualified him because of illegal modifications to the springs in his car. Hubert Westmoreland sued NASCAR. The judge dismissed the lawsuit.

Westmoreland sued NASCAR later, claiming US$10,000. A judge dismissed Westmoreland's lawsuit against NASCAR, ruling that NASCAR had the rights to create its own rules.

The NSCRA, an organization which ran stock car races, was a challenger to NASCAR's dominance during the early years. Smith was the leader of the newly created NSCRA. On June 19, Big Bill France organized a race for 150 stock cars in Charlotte. The race was organized in one night with very little notice.


Flock, who was leading the field after his Buick lost its wheel, took the white flag. Slick Smith, Flock’s teammate, joined him to help push Hudson towards the pits. But, NASCAR rules did not permit the car to be driven into the pits.
